A federal judge sets the date to hear arguments in gay rights case in Michigan

DETROIT (WKZO) -- A Federal Judge has set October First for arguments on the constitutional ban on same-sex marriage and gay adoption in Michigan.

The legal challenge was filed by two Detroit area nurses, Jayne Rowse and April DeBoer who complained that they were each allowed to adopt children, but prevented from adopting each other’s children as a gay couple.

The case has since been expanded to hear arguments on the state’s voter approved ban on same sex marriage.

A decision will come later this year and appeals could follow,  regardless of which side wins.
