Justices do more with ruling than just outlaw Michigan marijuana dispensaries

LANSING (WKZO) -- The State Supreme Court didn’t just outlaw dispensaries on Friday. The Justices primarily ruled that the State’s Medical Marijuana laws do not allow one patient to sell to another, nor does it give caregivers the right to sell their surplus to anyone beyond the 5 patients they are allowed to take on as clients.

That ruling effectively puts the dispensaries that have sprung up around the state out of business.

Nashville Republican Mike Callton has proposed legislation that would allow dispensaries that only deal with card carrying patients.

He says many of the state’s 126-thousand Medical Marijuana users cannot grow their own and there are not enough Caregivers to go around.

His concern is they will be forced to go underground to get their pot.

The high court ruling also effectively nullifies a voter approved measure in Kalamazoo requiring that the city establish zoning for three dispensaries in the city.

It was approved by voters last November, but never implemented because the state had outlawed them. The Supreme Court Decision

upholding that decision is the final nail in the coffin for the initiative.
