LANSING (WTVB) - The Michigan Court of Appeals has dismissed a Warren bar owner's lawsuit challenging the state's smoking ban. The appellate court ruled that since Sporty O'Toole's bar has gone out of business, and owner Boyd Cottrell says he doesn't plan on opening another bar, there's no reason to continue the lawsuit. Cottrell challenged the constitutionality of the smoking ban in a lawsuit against the Macomb County Health Department after his bar was twice cited for violations after the smoking ban went into effect in May 2010.
